Information Circular No 23/2020: Clarification- Parents Leave

Members are advised that the grant of Parents Leave is NOT with full pay.

Over the course of the past number of years a number of different type of leave for parents/adoptive parents has been introduced into regulations. To date, Maternity Leave, and Paternity leave have been given to personnel on a fully paid basis.

However, PDFORRA has recently been informed that like the wider public and civil sectors, the newest type of leave- Parents Leave, will not be fully paid and members will be required to apply for Social Welfare benefits under the Parents Leave and Benefits Act 2019.

The Department has proposed the following amendment to Section 33 of DFR A.11

(1)     A member who, in accordance with the Parent’s Leave and Benefit Act 2019 (No. 35 of 2019), is entitled to parent’s leave under that Act may be granted such leave subject to the leave being without pay and allowances.

(2)     Parent’s Leave shall reckon as qualifying service for the purposes of increments, seniority, promotion and annual leave. “.

Parents leave is awardable to:             A member who is:

(a)       the natural parent of a child, 

(b)       the adoptive parent of a child in respect of whom an adoption order has been made,

(c)       an adopting parent in whose care a child has been placed with a view to the making of an adoption order, or

(d)       acting in loco parentis to a child,

…  in accordance with the Parental Leave Acts 1998 to 2019, be granted parental leave subject to any such leave being without pay and allowances.”.
