Information Circular No 41/2019 – Legal Action – Tech Pay EMT’s

By Industrial Relations Officer

The Association was responsible for a legal case being brought before Dublin Circuit Court on the 17th of December last seeking damages in respect of one of our members not receiving appropriate technical pay despite practicing as an Emergency Medical Technician (EMT).

The Department, just before Court, agreed to make a payment to the individual member in the circumstances which effectively vindicated his position and the decision to take the proceedings.

The Association has sought for the Department to take a universal approach in relation to appropriate tech pay being paid to all appropriately qualified and practicing medical personnel but the stance of the Department has been, despite taking the matter to Court, to deal with these cases on an individual basis.

The Association will continue to pursue these entitlements by all means to include further Court proceedings, if necessary, and invites other PDFORRA members so affected to make contact with the Association to that end.
