Information Circular No 31/2019 – Payment of Outstanding Adjudication Awards

PDFORRA has agreed to the withdrawal on a “Without Prejudice” basis of the Association’s Judicial Review proceedings connected to the claims for the payment of the outstanding adjudications relating to members of the ARW, Chefs, Account Holders and the free rationing of Recruits and Apprentices.

The withdrawal of the Judicial Review proceedings provides for the payment of these adjudications back to October 1st 2018. Additionally, the withdrawal of the Review proceedings on the foregoing basis permits the Association to pursue further arrears where the terms of the adjudication permits.

PDFORRA has already sourced a number of individuals, both serving members and retired, with a view to meeting with the Association’s Solicitor to consider options – these persons will be contacted in the coming weeks.

At this juncture a number of options are open to our Association, including:

1.         Implementation Body of the Public Sector Stability Agreement 2018 – 2020.

2.         Potential route through the International Labour Organisation.

3.         Legal action through the Irish Courts.

All of the foregoing options possess, in and of themselves, unique challenges and downsides in terms of duration, scope for advancement and enforceability etc.

PDFORRA will consult with as many of the potential beneficiaries as possible; however, it may not be possible to consult with all.

Members, and retired members wishing to be considered for briefings/information, should contact PDFORRA in the coming weeks to register their interest in being consulted on the course of action the Association may take.

The Department have informed PDFORRA that they are currently in the process of correlating data for the payment of those personnel currently in applicable service, or who were in applicable service on 1st October 2018, in order to make payment in the coming weeks.
