Information Circular No 24/2014: Arrears Holiday Pay

Following the submission by PDFORRA on the 28th of March 2013, for the inclusion of any additional payments in pay during periods of annual leave where this is not already the case – the Department last December conceded PDFORRA’s claim and members were paid a sum of approximately €10 Million, inclusive of arrears.

The basis for the claim was as follows:

  • The provisions of the Working Time Directives 93/104/EC and 2003/88/EC concerning certain aspects of the organisation of working time and in particular Article 7 of both Directives, which provides that every worker will receive at least four weeks paid annual leave. 
  • In implementing the paid annual leave provision of the Directives, EU law requires that workers receive at least their normal remuneration during periods of annual leave. 
  • In all other areas of the public service regular bonus payments and allowances are included in annual leave pay of staff at least since the introduction of the Directives.

On the 1st of October 2014, the Department paid arrears from the last quarter of 2013.

The Department have recently indicated that arrears for the first half of 2014 will be paid on the 22nd of October 2014.
