Information Circular 19/2011Payment of Wages Act 1991

By General Secretary

1.     An increasing number of cases of late payments of Security Duty Allowance (SDA) and other monthly payments are being brought to the attention of the association.

2.     The failure to pay SDA and other payments on the monthly due dates may constitute a breach of the Payment of Wages Act 1991 under paragraph 5 (6). The one exception to this is where the deficiency or non-payment is due to an error of computation.

3.     All individuals and committees seeking the payment of SDA and other allowances on the appropriate due dates should emphasises that failure to make the payments at the correct time is a breach of the Act and that the issue can be addressed through the Rights Commissioner Service of the LRC.
