Information Circular No 07/2018: Decision of Social Rights Committee on Complaint Submitted by PDFORRA and Review of Conciliation & Arbitration Scheme

Following publication of the decision of the European Social Rights Committee, which found that Ireland is in breach of Article 5 and 6 of the European Social Charter, PDFORRA is now engaged in a review of the Conciliation and Arbitration Scheme with the Department of Defence.

Additionally, following the release of the decision by the Social Rights Committee, PDFORRA held a meeting with Ms Patricia King, General Secretary of the Irish Congress of Trade Unions (ICTU). This meeting was very worthwhile and resulted in an offer by the General Secretary of ICTU to speak directly with any officials chosen by the Department, if PDFORRA request it.

Moreover, PDFORRA has sought legal advice surrounding the securing of rights under Article 11 of the European Convention on Human Rights. This provision relates to Freedom of Association, and is legally enforceable.

The review of the Conciliation and Arbitration Scheme is scheduled to be completed within six (6) months from the appointment of the Independent Chair of the review body. This would result in the completion of the review by the end of June/July 2018.
